Fanvideos of shows and movies on Youtube considered a public performance?

You know how on dvd of shows and movies there's a warning sign by FBI saying no copying, public performance etc.... Well if you made a fanvideo on your favorite movie or show using clips directly from there and uploading your vid on youtube, is that considered public performance?
