Consumer rights....where do I stand? (UK.)?

I brought a bed from a firm about 6 weeks ago, but when I placed the order the salesman told me it was out of stock and would be with me in about 2- 21/2 weeks. I accepted that and payed the full amount (£148) After 3 weeks of not hearing anything from them I gave them a ring and was told it was still out of stock and they'd ring me when it was in. Another week later I still hadn't heard anything, so I rang them again and they said they'd get on to the supplier to chase the order up. They rang back 3 days later to tell me the beds weren't even in the country! The manager asked me to bear with him for a bit longer, bearing in mind it had already been 5 weeks since I placed the order, so I gave it until this weekend before traveling back to the store to sort it out in person. (About a 40 mile round trip) They offered me the display model, which was as you'd imagine display models to look, (knocks and scratches in the wood) with a measely £10 off. I was insulted so asked for my money back but because it was on Sunday, the manager wasn't in the shop and the salesman couldn't refund my money back onto my card there and then. I was dubious about him writing down my card details to be processed the next day, but had no other choice. He said the manager would refund the money 1st thing Monday. But when I was in town yesterday I popped into the back and asked the cashier if a refund would show up from that morning. He told me it would and check and there was nothing from them. So I rang up the bed company and spoke to the manager who said he did it 1/2 hour ago. But I have been to the bank this morning and there is still no record of the money going back into my account! I am really peed off that the manager would lie about it, and that I am still missing £148 of my money. What rights do I have? It's been a shoddy service from the start, with me constantly chasing them up. It hard for me to get to the shop cos like I said it's about 40 miles round trip. I just want my money!!

  1. i had a friend who had ordered a a item that she didnt get after about 8 weeks she went back and demanded her money back They can not refuse to give you your money back as they have not kept there end of the agreement, of delivery in 2 1/2 weeks. Good luck, get your money back and go find a more reliable shop to buy your bed. Its their loss

  3. I love these types of problems....i actually like stores to do this kind of thing to me cus they come out soooo much more worse off than me!!! Right okay, so firstly......which company was this!!? Im presuming its not a major high street on!?.....due to the customer service you are receiving! So refunds can take i think its about 3-5 working days to show on your account. If still nothing. My next steps would be to ring trading standards on 08454 04 05 06.......explain the situation to them. Now they are good because they will advise you what to do next, they will give you a reference to keep calling them with up to date info also. I like speaking to them because they will state things they are doing wrong to you e.g. breaking services and goods act of 1989. Theres no point anybody advising you what to do next when you can ring trading standards and they advise you around the law! Need any more info contact me or go to http://www.consumerdirect.gov.uk/
  4. He may have actually done the refund but it will take a few days to clear and appear in your account. Give it at least three days then check. If it still isn't back you could give trading standards a ring.
